Company agreements offer the possibility of introducing changes regarding: June 2012: Department for Correctional Services – Continuation of prisoner separation A prisoner in Yatala prison claimed that there was an agreement for him to be transferred to Port Augusta prison and that he would no longer be separated from other prisoners if he met certain criteria. He claims that he met the criteria and that the transfer was refused. The Ombudsman made a number of recommendations. November 2017: Coober Pedy District Council – Failure to declare a conflict of interest The Ombudsman received a transfer from the Commissioner for Cr Paul Reynolds` alleged failure to declare an interest in Coober Pedy District Council`s decision to implement an electricity catchment contract with Energy Developments (EDL). It was claimed that Cr Reynolds was interested in the case that resulted from his connection to the Coober Pedy Miners Association, the Coober Pedy Gem Trade Show and the Coober Pedy Opal Festival. Both the Coober Pedy Gem Show and the Coober Pedy Opal Festival are expected to receive annual sponsorship from EDL for the duration of a new contract with the Council. The sponsorship agreement was negotiated by the Coober Pedy Miners Association. Cr Reynolds did not express interest in the Commission`s review of the Power Purchase Agreement. The Ombudsman conducted an investigation and found that Cr Reynolds was interested in this matter, given that he was a member of the coober Pedy Gem Trade Show`s management body, which reasonably expected to gain an indirect benefit based on the outcome of the case. The Council stated that the Ministry had not fulfilled its consultation obligations under an agreement between the Land Government and the Local Government Association of SA.
The investigation concluded that the division was not acting in an unlawful, unreasonable or erroneous manner.
